The accused Conrad Bitzer, a person subject to Military
Law by reason of being within the limits of the Colony whilst the Order in Council of 26th. October, 1896, was in operation, this Order in Council having been brought into operation by Proclamation No. 8 of His Excellency the Governor and Commander-in-Chief of the Colony of Hongkong dated August 5th., 1914, is charged with:-
Conduct to the Prejudice to the Good Order and
Military Discipline:
in that he, at Hongkong, on or about August 31st., 1914, during a state of war, by posting a circular letter containing exaggerated statements of German victories to various residents in China, did thereby attempt to disseminate reports calculated to cause un- -necessary alarm and despondency amongst British or Chinese residents.
